Safety documents for transport work in Queensland

Transport work has two layers of law. On the road, the Heavy Vehicle National Law (Queensland) covers heavy vehicles, meaning those with a GVM or ATM over 4.5 t (s 6). Under its chain of responsibility, each party, including employers, operators, schedulers, consignors, consignees, packers, loading managers, loaders and unloaders, must ensure, so far as is reasonably practicable, the safety of its transport activities (s 26C). Each party must also ensure, so far as is reasonably practicable, that its conduct does not cause or encourage the driver to break the law or exceed a speed limit (s 26C).

At depots, yards and sites, work health and safety law applies as well. The person with management or control of powered mobile plant must manage risks such as collisions (s 214 of the Work Health and Safety Regulation 2011 (Qld)). Operating a forklift truck, or a vehicle loading crane of 10 metre tonnes or more, needs a high risk work licence (Schedule 3). Construction work on, in or next to a road in use by traffic, or in an area where powered mobile plant is moving, is high risk construction work (s 291(n) and (o)), so a SWMS is required (section 299).
