Terms and Conditions

The terms for using this website and buying our templates, including how you can use them.

These terms apply when you use worksafetyqld.com and when you buy or download a template from us. "We", "us" and
"our" mean Work Safety QLD, operated by RJG Mediaworks Pty Ltd (ABN 25 637 433 455), a privately owned company based in Brisbane, Queensland. "You" means the person or business using the site or buying a template. By using the site or
placing an order, you agree to these terms.

1. Our templates

Our templates are editable Microsoft Word and Excel documents, including safe work method statements (SWMS),
policies, procedures, forms, registers, checklists and toolbox meeting templates. They're written for Queensland
businesses as a starting point.

You're responsible for reviewing each template, assessing the risks of your own work, consulting your workers,
tailoring the document to your site and keeping it up to date with current legislation, regulations and codes of
practice. Our templates and guides are general information, not legal advice. Please read our
Disclaimer.

2. Your licence to use our templates

When you buy or download a template, we give you a non-exclusive, non-transferable licence to use, edit, print and
copy it for your own business, including your own projects, sites and workers. You can share completed documents with
the people who need them for your work, such as clients, principal contractors, auditors and regulators.

You must not:

  • sell, share, give away, publish or distribute the templates themselves, edited or unedited, as templates;
  • upload them to file-sharing sites, template libraries or marketplaces; or
  • include them in a template pack, course or other product that you sell; or
  • use them to prepare safety documents for other businesses as a paid service (for example, as a safety
consultant), unless we've agreed in writing.

Using a completed document for your own jobs is fine, including giving it to a client or principal contractor as
part of your work. If you're a consultant and want to use our templates for your clients, please
contact us first.

We own the copyright in our templates. Buying a template gives you the licence above, not ownership of the
copyright.

3. Your account

Every order creates an account so you can download your templates again. Please give accurate details and keep
your login secure. You're responsible for activity on your account, and you must not share your download links or
account with others.

4. Prices and payment

Prices are in Australian dollars and include GST for Australian customers. Customers outside Australia aren't
charged GST, so they pay the price less the GST. The total is shown before you pay, and every paid order comes with a
tax invoice from RJG Mediaworks Pty Ltd. Payments are processed securely by
Stripe, and you can pay by card, Apple Pay or Google Pay. We may change our prices at any time, but a change won't
affect an order you've already paid for. If a price is obviously wrong because of an error, we'll contact you
and either offer you the template at the correct price or cancel the order and refund you in full. If we cancel, the
licence for that template ends and you'll need to delete the files.

5. Delivery

All our products are digital downloads. Your download buttons appear as soon as your payment goes through, and we
email you the links. Your templates stay in your account so you can download them again later, but please save a copy
of your files. If a download doesn't work or the email doesn't arrive, contact us and we'll send your files.

6. Free templates

Free templates are covered by the same licence as paid templates. Downloading a free template adds you to our
mailing list for new templates and WHS updates, and you can unsubscribe at any time. We may change which templates are
free at any time.

7. Refunds

Our Refund Policy explains when we refund an order. Nothing in these terms limits
your rights under the Australian Consumer Law.

8. Guides and website content

Our guides and other website content are general information to help you understand work health and safety in
Queensland. They aren't legal or professional advice, and laws and guidance change, so check current requirements with
WorkSafe Queensland before relying on
them. Work Safety QLD is independent and isn't affiliated with Workplace Health and Safety Queensland or the
Queensland Government.

9. Other websites and sponsored content

Some pages link to other businesses' websites, and some guides mention businesses we have a commercial relationship
with. A mention doesn't mean a product or service will suit your work, and we're not responsible for other websites,
their products or their content.

10. Intellectual property

The content of this website, including our guides, templates, images, logo and design, belongs to us or our
licensors. Apart from the template licence above and normal personal viewing, you must not copy, reproduce or
republish it without our written permission.

11. Using the site

You must not use the site for anything unlawful, try to gain unauthorised access to it, interfere with how it
works, or copy its content in bulk (for example by scraping).

12. Our liability

Our products come with guarantees that can't be excluded under the Australian Consumer Law. Apart from those
guarantees, and to the extent the law allows:

  • because our templates are business documents, not something ordinarily bought for personal, domestic or household
use, our liability for failing to meet a consumer guarantee is limited, where the law allows, to supplying the template
again or refunding what you paid for it; and
  • we're not liable for any indirect or consequential loss arising from your use of the site, our guides or our
    templates.

13. Privacy

Our Privacy Policy explains how we handle your personal information.

14. Changes to these terms

We may update these terms from time to time. The version on this page when you place an order applies to that
order.

15. Governing law

These terms are governed by the laws of Queensland, Australia, and you agree to the jurisdiction of the courts of
Queensland.
