Safety documents for farm and rural work in Queensland
Most day-to-day farm work, such as mustering, spraying, harvesting and running a dairy, is not construction work, so a safe work method statement (SWMS) is only legally required when a job is construction work that is also high risk. Building or repairing a shed, yard or silo can be construction work (s 289 of the Work Health and Safety Regulation 2011 (Qld)). It becomes high risk construction work if it involves a risk of a person falling more than 2 m, or is carried out in or near a confined space (s 291), and section 299 then requires a SWMS before the work starts. For everything else, a written SWMS is still a sound way to show how each task is controlled and to brief your crew.
Rules that come up on farms
Rural plant: the approved Rural Plant Code of Practice 2024 covers tractors, quad bikes and other rural plant. A code is not law in itself, but you must follow it or manage the risk to an equivalent or higher standard (s 26A of the WHS Act).Quad bikes: the person with management or control of a quad bike must take all reasonable steps to ensure the operator is at least 16 years old (or the manufacturer’s recommended age) and wears a crash helmet, and that a passenger is carried only where the bike is designed for one (ss 226A-226C of the WHS Regulation).Silos and bins: a worker must not enter a confined space, such as a silo or hopper, until the confined space division has been complied with (s 65).
